I. General
- Please remember that by commissioning me, you're not only paying for the final product, but also for my years of expertise and problem solving skills in the craft
- All produced commissioned artworks are of digital nature and won't be delivered physically as a painting and/or print unless explicitly stated.
- If the customer didn't reply within +7 days after the artist first reached out to them due to being picked for a commission slot, the artist may choose another client instead.
- Please write in a clear manner to avoid misunderstandings
- Please respond to messages in a timely manner
- Provide good reference for what you want me to draw. Multiple images from different angles are best suited here. When your references don't explicitly show/provide necessary information about details or form, tell me.
- Commissions with non-visual references (e.g. text-based or combining elements from different designs. Or just plain new designs) may be subject to extra charges, due to increased workload, or may be outright rejected.
- The customer has to provide all necessary references for the drawn artwork prior to it being started working on. This includes: Color regions and patterns, anatomy details, body features (Hair/Feathers/Scales and such). If one of those things is not visible in any of the provided references, the customer has to communicate those in another way (text, sketches etc.). Critical references that are only provided at a very late stage of the artwork or suddenly require massive changes after the concept sketching may be charged additionally due to the high loss of time depending on the necessary changes.
- Unacceptable behaviour (harassment, trolling etc.) won't be tolerated and possibly lead to immediate cancellation of the order with a partial refund as stated in Section 3.
- Please provide honest feedback to WiPs and don't hesitate to tell me if you think something is off/wrong - In the end, you are the one the artwork is for!
- To prevent the workload from exploding on a single artwork, a total of 4 major changes (different pose/significant anatomy changes, different character shapes/details) are allowed on a per-character basis in an artwork during the concept/rough sketch/thumbnail-stage. The same number of significant changes are allowed for the environment in the artwork. This is a limit that's typically never reached and therefore only applies for special cases. I'll inform you about this before the limit applies. After said stage, described changes are charged additionally.
- Additionally charged changes - Values by stage:
- Clean Lineart Stage: Up to 20% of the commission price, based on progress and required changes
- Coloring, Shading/Rendering Stage: Up to 35% of the commission price, based on progress
- Almost finished Rendering Stage: Up to 75% of the commission price, based on progress
- Extras of the chosen commission option also can be added at a later stage for an additional fee on top of the options value
- Switching features (scales to fur or feathers etc.) during any stage after the concepting is charged with a portion of the new features price, depending on the progress already made on the previous one (When already in the final stages, the full value is charged etc.).
II. Payment
- Payment is done via PayPal Invoice
- Payment currency is EUR (€). Cryptocurrencies are not accepted
- When applicable: Additional charges due to situations as stated in section I are also due upfront via PayPal Invoice before they are ultimately made.
III. Refunds
- In case the customer wants the order to be cancelled while the order is still being worked on, the refunded amount will be based on how much of the work already is done at that point of time. The customer still will receive the latest WiP shot of the project.
IV. Copyright
- The artist holds the copyright to the produced artwork
- You may not remove the artists signature from the finished artwork or WiP shots. If the signature is cropped out intentionally, credit must be given.
- The customer is allowed to alter the commissioned file(s) under the previously mentioned restriction.
- Neither the customer, the artist, or any other entity is allowed to feed the commissioned work into generative AI Art algorithms.
- The customer may upload the high resolution file(s) of the artwork to public platforms (Social Media, Art Pages etc.) on their own risk. Those files are intended for zoomed in versions (a.E.: avatars) and as a reference for other artists etc. It is strongly advised to not upload them anywhere where it leads to the public having access to the full resolution files.
- The customer is allowed to use the commissioned file(s) for personal non-commercial use cases (Such as personal prints)
- If the customer wants to use the commissioned files for commercial purposes, this has to be declared during or even before the planning process. Artworks for commercial use are priced individually and licensed based on their use case. Let's all be fair to one another.
- The artist may use the artwork for commercial purposes (Such as commercial prints), as long as the character owner or legal rights holder of the design grants their explicit written permission to do so. The artist will contact the customer when there are plans to do so.
- The customer may not resell any commission(s) or adopt(s) received from me through a Non Fungible Token (NFT) or any other form of cryptocurrency. This also applies for every other entity outside of the artists customers. Artworks and designs may be sold by the respective character owner as part of character auctions/adopts. If the customer were to violate this clause, the artist may resell the design to another customer.
V. File Access
- The artist distributes the project files to the client via Google Drive.
- Access to aforementioned files is granted on a lifetime basis, but the artist is not liable for circumstances where forces beyond control wipes or destroys the data.
VI. Privacy Policy
- The artist won't transmit your provided real name, adress or E-Mail adress on any platform or to any third-parties outside of payment processors. Those customer information are being deleted from the submitted request form(s) after the service work is either completed or cancelled in any way.
- If the customer provides above mentioned data via E-Mail or any other communication way except for the provided request form(s), this data won't be deleted necessarily, as the full conversation should be kept on record if legal reasons should ever occur.
